A former Ambassador raises serious allegation against former Director of CIIL: Govt must clarify

Abasar Beuria, a former Ambassador,has informed the Chief Secretary, Orissa that Dr. Debi Prasanna Pattanayak, a former Director of Central Institute of Indian Languages, has committed irregularities and has misused the Government quarter that was allotted to him in his name.

In his numberless and dateless letter to Chief secretary A. P. Padhi, which Sri Padhi has received on May 29, Beuria has claimed to have “received complaints” against Dr. Pattanayak in the capacity of being his successor in IOSR, a non-government organisation the State Government has profusely patronized in contravention of all administrative norms.

The government quarter in question is also the epicenter of various irregularities in the Government. I have informed the CS how his as well as the Chief Minister’s orders over this quarter were tampered with by the Additional Director of Estates and the Rent Officer to suit the nefarious design of the NGO.

This single instance may be taken as a classic example of how top officials are working as tamed animals of corrupt fellows and how are these fellows patronized if an iota of feeling is generated in the Government that they are against Bhasha Andolan.

Sub: Wrongful use of Govt Qrs No.3R-9, BJB Area, Bhubaneswar by tampering with YOUR ORDER dt. 21.4.2016 as well as the CM’S ORDER dated 25.10.2016 in Notings for File No.GAD-CA-AS-0017-2014

Ref. Office Order No. 23135/GA, Bhubaneswar, dated 3rd Nov.2016 allotting Qrs N.3R-9 BJB Area to Dr. Devi Prasanna Pattanayak read with Resolution 4 , dated 25.4.2016 of the Ministerial Committee on working of Orissa Official Language Act,1954. AND with Dr. Pattanayak’s application FOR A SITTING SPACE dated 3.7.2015 vide Dy -19450/GAD/ dt 6.7.2015, FURTHER read with Dr. Pattanayak’s e-mail to Chief Secretary, Odisha dt.27 May 2019

Sir,

The Chief Minister of Orissa, in Noting 47 dated 25.10.2016 for File No.GAD-CA-AS-0017-2014 approved your proposal under Noting 46 dated 21.4.2016 that read, “Keeping in view the stature of Dr. Pattanayak, the quarters may be allotted in his name as Chairman, Institute of Odia Studies and Research.”

In making this order, you had rejected the proposal of G.V.V.Sharma, Principal Secretary, GAD to allot a type V Qrs to the NGO called Institute of Odia Studies and Research.

Noting 45 dt 21.4.2019 of Sri Sharma may please be perused. He had linked Sri Pattanayak’s request for “A sitting space” and said, “We tried to examine possibility of providing office space in CMGI, as ordered by the then Chief Secretary at Noting 38. But it is seen that this is not feasible. We may therefore consider allotting a type V quarters to this NGO for a period of five years.”

You had rejected this proposal to allot the govt. qrs. to this NGO (Institute of Odia Studies and Research) and instead of that, you had proposed that, the qrs may be allotted to Dr. Pattanayak “in his name” and the Chief Minister had APPROVED YOUR PROPOSAL.

After the CM agreed to YOUR PROPOSAL in Noting 47, Ganeswar Jena, Addl. Director of Estates, GAD, in his Noting 50 dated 1.11.2016 put up the proposal for Orders that read, “Qrs No.3R-9, BJB Area may be allotted in favor of Dr. Debiprasanna Pattanayak, Chairman, Institute of Odia Studies and Research, Bhubaneswar for a period of five years.” You approved this in your Noting 52, dated 1.11.2016 with the observation that the said allotment proposal was “in line with” the CM’s order, although neither Dr. Pattanayak had applied for five years nor had you suggested that the allotment should be made for five years.

Neither there were any orders for residential use of the same and renewal of the allotment after the term of five years nor there was any order for payment of the rent by Chairman of the NGO named above. But, all these provisions were inserted into the Memo No. 23136/CA, dt.03.11.2016 and into the Agreement dt.5.12.2016.

On the other hand, Sir, allotment of a government qrs to Dr. Pattanayak to be used as a workplace for preparation of Language Policy was mooted in the Ministerial Committee, which was being coordinated by the then Principal Secy., GAD, Sri Sharma, who had suggested for the allotment in favor of the NGO,which, as shown supra, you had rejected.

The mooting in the Ministerial Committee had gone off-the-record, generating resentment in Dr. Pattanayak. He was not satisfied with Sharma’s revelation in the meeting that his request for a “sitting space” was being seriously considered and the CM had been moved to approve the same. Dr. Pattanayak had insisted that to help him finalize the language policy, not only a govt. building for office should be given to him, but also the same should be equipped with other amenities like Computers, data entry operators etc. That was taken into records as a Resolution, which was worded as follows:

“ମନ୍ତ୍ରୀସ୍ତରୀୟ କମିଟି ନିଷ୍ପତ୍ତି କ୍ରମେ ପ୍ରମୁଖ ଭାଷାତତ୍ତ୍ଵବିତ୍ ପଦ୍ମଶ୍ରୀ ଡଃ ଦେବୀ ପ୍ରସନ୍ନ ପଟ୍ଟନାୟକଙ୍କୁ ଓଡ଼ିଆ ଭାଷା ନୀତି ପ୍ରଣୟନ ନିମନ୍ତେ କ୍ଷମତାର୍ପିତ କରାଯାଇଛି । ଏଥି ନିମିତ୍ତ ସର୍ବନିମ୍ନ ଅସୁସଙ୍ଗିକ ସରକାରୀ ଭିତ୍ତିଭୂମି (ଅଫିସ ଗୃହ ,କମ୍ପୁଟର , ଡାଟା ଏଣ୍ଟ୍ରି ଅପରେଟର ପ୍ରଭୃତି ) ଯୋଗାଇଦେବା ପ୍ରସ୍ତାବ ସାଧାରଣ ପ୍ରଶାସନ ବିଭାଗ ବିଚାର କରିବେ (ଓଡ଼ିଶା ସରକାରୀ ଭାଷା ଅଧିନିୟମ, ୧୯୫୪ର କାର୍ଯ୍ୟକାରୀତା ଓ ଅଗ୍ରଗତି ସମ୍ବନ୍ଧରେ ତା ୨୫.୦୪.୨୦୧୬ରିଖ ଅପରାହ୍ନ ୫.୩୦ ଘଟିକା ସମୟରେ OCAC ସମ୍ମିଳନୀ କକ୍ଷରେ ଅନୁଷ୍ଠିତ ହୋଇଥିବା ମନ୍ତ୍ରୀସ୍ତରୀୟ ବୈଠକର ପ୍ରସ୍ତାବ -୪ ) ।

Thus, the allotment of qrs No.3R-9 BJB Area to Dr. Debi Prasanna Pattanayak “in his name” was meant only to be used as a sitting space/ an office for preparation of the Language Policy by Dr. Pattanayak and for no other purpose.

This allotment was co-terminus with preparation of the Language Policy. It was never meant for any NGO work and hence, rejecting the suggestion by the Principal Secretary GAD, G.V.V.Sharma (Noting No. 45) to allot the govt.qrs. to the NGO (Institute of Odia Studies and Research) for five years, you had noted that the qrs be allotted to Dr. Pattanayak IN HIS NAME with his designation “Chairman, Institute of Odia Studies and Research. AND the CM, much after the above quoted resolution of the Ministerial Committee, had approved your suggestion for allotment of the qrs to Dr. Pattanayak in his name, while ignoring the extra recommendations of the Committee for equipping the said qrs with computers and data entry operators etc.

When in my professional capacity I legitimately perused the details of this allotment, to my shock I found that yours as well as the Chief Ministers orders at Noting at 46 and 47 have been tampered with in the order of allotment shrewdly putting ingredients to do away with the distinctive character of the allotment to an individual “in his name” and to make it hazy enough to accommodate the NGO in his place.

I had apprised you of this mischief in my letter dated 15.2.2017 and requested you therein to cancel the allotment immediately for the fraudulent tactics used to misuse a government property by a NGO of dubious character. But no action was taken against the Addl. Director of Estates as well as the Rent Officer where the tampering on the Govt. Order was carried out.

Because of these lacunae in dealing sternly with the offenders, the said Govt. qrs was blatantly misused.

Letter of the ADM, Bhubaneswar, bearing No.407 dt. 02.02.2018 addressed to the Rent Officer GAD is evidential in this regard. Departmental enquiry came out with evidences of flagrant misuse of this qrs in stark contravention of the orders the CM had made on your recommendation.

On being thus exposed by the departmental enquiries, Dr. Pattanayak has sent you the following mail on May 27, 2019 at 12.25 PM. I am giving here a relevant extract thereof for your ready reference: It reads, “Qrs. No. 3R9, BJB Nagar had been allotted to me by name, Dr. D.P.Pattanayak, Chairman, IOSR for official use. I had given in writing to the Trustees that I shall surrender the house to the Government, if not vacated for official use. The Trustees decided to maintain the statusquo. As I have resigned as chairman, I am therefore informing the govt. through you so that you may take action as you deem fit.”

In Noting 3 dated 29 May 2019 for File No. GAD-RCOM-RPP-0003-2019, the Director of Estates affirmed the offense in the following words:

“The enquiry report interalia reveals that a major portion of the quarters has been occupied by Dr. Prusty, the Secretary of the Institute and residing there with his family. Only a small room is being used as the office of the above Institute.”

He submitted, “As this is breach of terms and conditions of the lease deed, a show cause notice may be issued to the allottee for cancellation of the lease agreement and allotment of qrs.”

In Noting 5, Dt.31 May 2019 you were pleased to approve the proposed action.

The allottee being Dr. Pattanayak in his name, as per your order at Noting 5, the Rent Officer had issued notice No.3224/Rent dt.7.6.19 to Dr. Pattanayak to show cause as to why the allotment of the qrs in his name should not be cancelled for admitted and evidenced misuse and why should he not be evicted. But, surprisingly, the same Rent Officer resorted to a new mischief by preferring the Chairman of the above named NGO letter No. 3225/Rent on the same day calling for why the same action suggested to Dr. Pattanayak should not be taken against him. This is a trick to give legitimacy to the said NGO keepink the quarter under its possession, although the qrs was never allotted to this NGO.

Now, the said NGO is playing tricks to transfer the same qrs to its name through its new Chairman, which, if approved, will violate the Orders of the Chief Minister dated 25.10.2016.

Conscious as I am that Dr. Pattanayak was rewarded with allotment of the said qrs for his and his associates’ obnoxious wordy attacks on the Bhasha Andolan, I am making this representation to you not to fall in the trap laid by Sri Pattanayak and to take principled steps to cancel the allotment of qrs No.3R-9, BJB Area standing in name of Dr. Pattanayak who has already intimated you by name about surrendering of the quarter and to please subject him to penal rent from the date of his occupation of the qrs for having sublet the house to Subrat Prusty on the very same day the qrs was handed over to him after registration of the deed of agreement on 5.12.2016.
